Welcome to Cratify! These Terms of Service ("Terms") govern your access to and use of the Cratify mobile application and related services (collectively, the "Service") provided by Cratify ("we," "our," or "us").

      By using Cratify, you agree to these Terms. Please read them carefully before using the Service. If you do not agree to these Terms, you may not access or use the Service.
    

1. Acceptance of Terms

By creating an account, downloading, accessing, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Description of Service

Cratify is a home inventory and organization application that allows you to:

Create and manage locations, rooms, boxes, and items
Use QR codes to quickly identify and access box contents
Upload photos and use AI-powered item identification
Search across your inventory
Print labels for physical organization

3. Account Registration

3.1 Account Creation

To use the Service, you must create an account. You agree to:

Provide accurate, current, and complete information
Maintain and update your information as needed
Keep your login credentials secure and confidential
Immediately notify us of any unauthorized use of your account

3.2 Account Responsibility

You are responsible for all activities that occur under your account. We are not liable for any loss or damage arising from unauthorized use of your account.

3.3 Age Requirement

You must be at least 13 years old to use the Service. By using the Service, you represent that you meet this age requirement.

4. User Content

4.1 Your Content

"User Content" includes all data, text, photos, and other materials you upload, submit, or create through the Service. You retain ownership of your User Content.

4.2 License to Us

By submitting User Content, you grant us a limited, non-exclusive license to store, process, and display your content solely for the purpose of providing the Service to you. This license ends when you delete your content or account.

4.3 Content Restrictions

You agree not to upload or submit content that:

Violates any applicable law or regulation
Infringes on intellectual property rights of others
Contains malware, viruses, or harmful code
Is fraudulent, deceptive, or misleading
Harasses, abuses, or threatens others

5. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

Use the Service in any way that violates applicable laws
Attempt to gain unauthorized access to the Service or related systems
Interfere with or disrupt the Service or servers
Reverse engineer, decompile, or attempt to extract source code
Use automated means to access the Service without permission
Use the Service to send spam or unsolicited communications
Impersonate another person or entity

6. Intellectual Property

6.1 Our Property

The Service, including its original content, features, and functionality, is owned by Cratify and protected by intellectual property laws. Our trademarks and trade dress may not be used without our prior written consent.

6.2 Feedback

If you provide us with feedback or suggestions, you grant us the right to use such feedback without restriction or compensation to you.

7. Third-Party Services

The Service may integrate with or contain links to third-party services (e.g., Firebase, Google Cloud, AI services). Your use of such third-party services is subject to their respective terms and policies. We are not responsible for third-party services.

8. Subscription and Payments

8.1 Free and Paid Features

The Service may offer both free and paid features. Paid features require a subscription or one-time purchase.

8.2 Billing

If you subscribe to paid features, you agree to pay all applicable fees. Subscriptions automatically renew unless cancelled before the renewal date.

8.3 Refunds

Refund requests are handled according to the policies of the app store through which you made the purchase (Apple App Store or Google Play Store).

9. Termination

9.1 By You

You may stop using the Service and delete your account at any time through the app settings.

9.2 By Us

We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including if we believe you have violated these Terms.

9.3 Effect of Termination

Upon termination, your right to use the Service will immediately cease. Provisions that by their nature should survive termination will survive.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.

We disclaim all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

The Service will be uninterrupted, secure, or error-free
Results from the Service will be accurate or reliable
AI-powered features will always correctly identify items
The Service will meet your specific requirements

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, including but not limited to loss of profits, data, or use, arising from your use of the Service.

Our total liability for any claims arising from the Service shall not exceed the amount you paid us, if any, in the twelve (12) months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless Cratify and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

13. Dispute Resolution

13.1 Governing Law

These Terms shall be governed by the laws of the State of California, United States, without regard to conflict of law principles.

13.2 Informal Resolution

Before filing any legal action, you agree to attempt to resolve disputes informally by contacting us.

14. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes through the app or by email. Your continued use of the Service after changes constitutes acceptance of the updated Terms.

15. General Provisions

Entire Agreement: These Terms constitute the entire agreement between you and Cratify regarding the Service.
Severability: If any provision is found unenforceable, the remaining provisions will continue in effect.
Waiver: Our failure to enforce any provision is not a waiver of our right to enforce it later.
Assignment: You may not assign these Terms without our consent. We may assign our rights freely.
